Legal Requirements of Food Premises Operators

Food safety plays an important role when it comes to running a food premises. Food that is not handled safely could cause a food-borne illness. In Ontario, food premises must follow certain legal requirements. As a food premises operator, it is important to understand:

  • Your role and responsibilities
  • Steps to get approval for a food premises
  • How to operate your food premises safely to prevent food-borne illness

Food premises are regulated by a set of rules that operators must follow to ensure the food they prepare is safe. It is the responsibility of everyone working in a food premises to make sure they know the rules and how the rules apply to them.

Health Protection and Promotion Act (HPPA)

Every province has its own provincial health acts and regulations. The Health Protection and Promotion Act, 1990 (HPPA) of Ontario mandates regulations, programs and protocols that govern food premises. The Act gives public health inspectors (PHIs) the authority to inspect all food premises under Ontario's Food Premises Regulation. The HPPA also explains the powers of the Medical Officer of Health and the PHI. Some of these powers include:

  • Power of entry
  • Power of seizure
  • Power of destruction
  • Power to make an order

Food Premises Regulation

The Ontario Food Premises Regulation (R.R.O. 1990, reg. 562) is a provincial law that outlines the minimum standards an Ontario food premises must follow. The Food Premises Regulation requirements include:

  • Building maintenance
  • Lighting & ventilation
  • Equipment
  • Food handling
  • Meat & meat products/milk & milk products/eggs
  • Personnel
  • Washrooms
  • Cleaning & sanitizing of utensils

Public health inspectors at Lambton Public Health regularly inspect food premises to ensure they meet the requirements of the Ontario Food Premises Regulation. It is the responsibility of everyone working in a food premises to make sure they know the rules and how the rules apply to them.

Lambton County Food Safety Inspection Disclosure and Certified Food Handler By-Law

In September of 2009, the County of Lambton passed the "Lambton County Food Safety Inspection Disclosure and Certified Food Handler By-Law."
The bylaw made food handler certification mandatory and also endorsed the creation of a food safety disclosure program known as DineSafe Lambton. One element of DineSafe includes the posting of green, yellow, or red sign at the entrance to a Lambton County food establishment to protect and to promote the health of the public in our community.
